OVERVIEW
New York State adult-use cannabis license applications are hosted on the New York Business Express (NYBE) website.
Here, applicants can provide all the necessary information to acquire, upon approval by the Cannabis Control Board, a
New York State cannabis license and participate in the legal adult-use cannabis market.
The licensing application is currently closed. The Office is set to reopen the Processor Type 3 Brand license application
in January for all, including transitioning AUCCs and AUCPs. Get ready for your chance to enter the New York cannabis

The journey through New York State Adult-Use Cannabis License Applications will be between 2 and 4 parts

Note: Applicants for a cultivator, processor, or distributor license must submit proof of location control to be
considered in this application window. Applicants for a retail dispensary or microbusiness license who apply with
proof of control over a location will be on track to go through the November 3rd approval process.
The Primary License Application section collects basic information about the business pursuing the license, the
license type, and desired activities. This may include NYBE business profile with basic contact information, attestations,
trade secrets, organizational documents, and more.
Note: Location information, operating activities, hours of operation, proof of ownership/lease over the property,
community impact plan, community leadership roles, Department of State (DOS) certificate of authority and agreement
with building and construction trades are all optional information for primary license application submission.
The Social and Economic Equity (SEE) Certification section requests information from applicants seeking to
determine whether the applicant qualifies for Social and Economic Equity status. More information is available at the
Office’s SEE Guidance webpage.
The True Parties of Interest (TPI) Disclosures section includes questions to determine the TPIs of the applicant
seeking licensure. The majority of this information will be collected on the applicant’s own TPI disclosure in the TPI
portal. More information about TPI and the TPI disclosures are available below and at TPI Guidance.
Note: Applications will NOT begin to be reviewed by OCM licensing staff until all TPI disclosures have been submitted.
TPI disclosures that lay out the identities of all TPIs cannot be submitted in the TPI portal until the primary license
application is submitted.
The Location and Operations section collects required information to deem licensees operational. All applicants must
submit proof of control over licensed premises to complete the application and be considered for a final license,
except applicants for retail dispensary and microbusiness licenses, who may pursue a provisional license. More
information is available in the application guidance, and the Office has made guidance available for applicants to do a
self-assessment of their proposed retail location.
Retail Dispensary and Microbusiness Provisional Licensees: If more time is needed to complete the necessary steps
to secure a location, an applicant for a retail dispensary or microbusiness license that intends to sell its own cannabis
products can apply without location details. If determined eligible and selected for licensure through the application process,
the applicant will become provisionally approved and have twelve (12) months to submit the remaining location information
and documentation before being fully licensed and operational. All licensees must submit a Certificate of Occupancy or its
equivalent prior to commencing operations.

Adult-Use
Cultivator
Cultivator means any person who grows, clones, harvests, dries, cures, grades, and trims
cannabis plants for the purpose of resale. A cultivator’s license authorizes the acquisition,
possession, distribution, cultivation, and sale of cannabis from the licensed premises of the adult-
use cultivator to a licensed processor.

Processor
Processor means any person authorized to extract concentrated cannabis and/or compounds,
blends, infuses, extracts, or otherwise manufactures concentrated cannabis or cannabis
products for the purpose of resale. A processor license authorizes the acquisition, possession,
processing, and sale of cannabis from the licensed premises of adult-use cultivators to licensed
distributors.
Adult-Use
Distributor
Distributor means any person who sells at wholesale cannabis and cannabis products for
purposes of resale. A distributor’s license authorizes the acquisition, possession, distribution, and
sale of cannabis products from the licensed premises of a licensed adult-use cultivator, adult-use
processor, adult-use cooperative, microbusiness, or registered organization, authorized to sell
adult-use cannabis to licensed retail dispensaries and on-site consumption sites.

Microbusiness*
Microbusiness operator means any person who may act as a cannabis producer for the
cultivation of cannabis, adult-use processor, distributor, and retailer. A microbusiness license
authorizes the limited cultivation, processing, distribution, delivery, and sale of their own adult-
use cannabis products and cannabis. Microbusinesses can also become a Cannabis Event
Organizer.

Dispensary
Retailer*
Retail dispensary operator means any person authorized to acquire,possess, sell, and deliver
cannabis productsfrom the licensed retail dispensary premises to cannabis consumers. Retail
dispensary operators can also becomea Cannabis Event Organizer.

BENEFITS OF APPLYING AS A SEE APPLICANT
Application fees are reduced by 50% for all Social and Economic Equity (SEE) applicants and licensing fees are
reduced by 50% for eligible SEE licensees. To qualify for SEE status, sole control of the application must be held
by an individual or individuals from a community disproportionately impacted (CDI) by the enforcement of
cannabis prohibition, a minority- or woman-owned business, a distressed farmer, or a service-disabled veteran.

All applications must be submitted online through NYBE.

Each application has a save and resume feature. Applications do not need to be completed within one sitting.
After completing, the applicant can log in to NYBE at any time to check application status.

in New York State. Please note that this is only the first application window for general adult-use
cannabis licensing. Future application windows for licenses such as nursery, delivery, cooperative
